A 14-year-old female student was raped and sodomized in a her school’s restroom after teachers failed to follow-through with an agreed plan to use her bait to catch a school rapist, a court heard.
The unfortunate incident happened in January 2010 in a Sparkman Middle School, Alabama in the United States.
Court records indicate the 14-year-old girl was raped after teacher’s aide June Simpson told her to go into a boys’ restroom with the 16-year-old boy, who had reportedly been harassing several girls and asking them to have sex with him.
Simpson told the girl that the school administration could punish him if they could “catch him in the act” and when neither Simpson nor any other school official followed the teens into the bathroom immediately, the girl was sodomized, AL.com reports.
“A school board cannot avoid summary judgment as a matter of law when a school administrator willfully ignores a plan to use a 14-year-old special needs student as bait to catch a student with a known history of sexual and violent misconduct, and as a result, the student is sodomized,” reads the federal brief filed by the United States Department of Justice.
Both he and the victim were special needs students.
The boy was known in the school has a long history of sexual infractions – before and after – the rape incident. Several girls made complaints to the school authorities on being assaulted by the him. He has also been caught watching pornography with school computers.
