Ayodele Fayose, the governor of Ekiti State, on Thursday, December 15, 2016 stormed the Ado-Ekiti branch of the Zenith Bank to make a withdrawal from his bank account which had been frozen by the Economic and Financial Crimes Commission, EFCC.
A federal high court had ordered on Tuesday that his account be unfrozen with immediate effect, after finding the EFCC action unconstitutional and hence, unlawful.
Governor Fayose who made a withdrawal of N5 million in cash thanked Nigerians for standing with him and against the recklessness of the EFCC.
The accounts were frozen by the EFCC in June 2015.
The judge said the EFCC action breached the governor’s fundamental rights to fair hearing, as the commission did not make him a party to the proceedings for the interim freezing of the account.
He said that the EFCC suppressed facts by not disclosing to the court that granted the interim freezing order that the two accounts that were frozen belonged to Governor who enjoys total constitutional immunity.
Coincidentally, today, the Nigerian Senate rejected the nomination of Ibrahim Magu as the chairman of the EFCC. The Senate formally declined confirmation of his nomination for the position siting a negative security report from the country’s secret police.
Under Magu, the public image of the anti-graft agency as a crime fighter, was tarnished after series of unlawful actions by the EFCC, disobedience to court orders, and gross violation of human rights of Nigerians.
Magu politicized his position and became known as the “hatchet man” for President Buhari and the All Progressives Congress, APC.
