A High Court sitting in Abakaliki, the Ebonyi State capital on Wednesday, March 4, 2015 restrained the Ebonyi State House of Assembly from proceeding with impeachment procedures against the State Governor, Martin Elechi.
Making the ruling was Justice John Igboji, who granted an ex parte motion filed by Governor Elechi against the Speaker Chukwuma Nwazunku and Chief Whip, Kingsley Ikoro, on behalf of other members of the House, praying for an interim injunction restraining the lawmakers from continuing impeachment procedures.
G. Tagbo Ike, Governor Elechi’s counsel filed the motion which was pursuant to order 4 Rules 3 and 4 (c) (iv) and (v); Order V Rule 7(b) and (d) of the Fundamental Rights (Enforcement Procedure) Rules, 2009.
The court granted the interim injunction stopping the Chief Judge of the State from constituting a 7-man panel to investigate allegations leveled against Governor Elechi, pending the determination of the substantive application.
