ABUJA, Nigeria – Justice Inyang Edem Ekwo of the Federal High Court in Abuja has issued an injunction preventing the Peoples Democratic Party (PDP) from suspending outgoing Rivers State Governor Nyesom Wike and Governor-elect Simi Fubara over allegations of anti-party activities.
In his judgment delivered on Tuesday, April 18, 2023, Justice Ekwo ruled in favor of Wike and Fubara, who had filed separate suits against the PDP.
The judge emphasised that due process of law must be followed by any organisation established by law when dealing with legal issues.
Justice Ekwo stated, “The due process of law must be followed by any organization set up by law while dealing with issues relating to law.”
He further restrained the PDP’s national leadership from annulling the memberships of both Wike and Fubara over the alleged offences.
The ruling has provided a reprieve for Governor Wike and Governor-elect Fubara, who can now continue their party membership without the looming threat of suspension.
The PDP has not yet issued an official statement in response to the court’s decision.
